These Terms of Service (“Terms”) govern your access to and use of the PlantMaster website, apps, and APIs. Please read these Terms carefully, and contact us if you have any questions. By accessing or using PlantMaster, you agree to be bound by these Terms.

Using PlantMaster:
a. Who can use PlantMaster
You may use PlantMaster only if you can legally form a binding contract with PlantMaster, and only in compliance with these Terms and all applicable laws. When you create your PlantMaster account, you must provide us with accurate and complete information. You can’t use PlantMaster if it would be prohibited by U.S. sanctions. Any use or access by anyone not listed in your account sign up is not allowed. Using PlantMaster may include access to updated software. You agree that we may automatically update that software, and these Terms will apply to any updates.
b. How many people can use PlantMaster
If you create a PlantMaster account for “Single User” (Annual or Monthly) only one person may use PlantMaster. Any use or access by anyone not listed in your account signup is not allowed. If you need have more than one person access PlantMaster, you must purchase a PlantMaster “Office Account”. Only the persons listed on the account may contact PlantMaster for training or technical support. We retain the right to refuse service to anyone abusing this policy. If you need to downsize your account, we do not offer partial refunds. We will update the pricing at the next renewal date. If you add people to your account, you will pay the difference in price immediately.

You may NOT have more than one person using PlantMaster. One user per account. If you need to have more than one person accessing PlantMaster, you must purchase an Office account. Please see our pricing page for options – plantmaster.com/signup
c. How long you can use PlantMaster
PlantMaster is a subscription based tool. By agreeing to our terms, you agree that you will be charged on your billing date until you cancel your account. We will work with you if you have any financial hardship or need a refund, but you are responsible to close your account if/when you are ready to terminate using your PlantMaster account.
d. How long you can use PlantMaster Student Edition
If you are enrolled in college classes, you may use PlantMaster student edition at the discounted rate for a limit of (2) years. After this period, your account will be automatically closed. If you are still in school you can contact us to verify your current/ongoing enrollment. Otherwise, to continue using PlantMaster you will need to purchase a professional account at the close of the two year period starting on your first billing date.
e. Our license to you
Subject to your compliance with these Terms of Service, we grant you a limited, non-exclusive license to submit, post, reproduce, publish, distribute or otherwise transmit, create and view designs, data, information and/or other files or content using PlantMaster.
f. License restrictions
PlantMaster reserves all rights not granted to you under these Terms of Service. To the fullest extent permitted under applicable law, you are prohibited from doing any of the following: (a) transferring any or all of the Service, or any rights granted to You by these Terms of Service, to any other person or legal entity; (b) removing, altering or obscuring any copyright, trademark, confidentiality or other proprietary notices, labels or marks from or on the Service; (c) modifying, translating, adapting, arranging or creating derivative works based on the Service; (d) decompiling, disassembling or otherwise reverse engineering the Service; or (e) determining or attempting to determine any source code, algorithms, methods or techniques used or embodied in the Service. You may not export, download, or otherwise use any images or data outside of our presentations, from PlantMaster without our express permission.

You may NOT give your account to another person. You may NOT hide or remove our branding. You may NOT attempt to reverse engineer or recreate our software. Please don’t steal our hard work.
g. Modifications of service
PlantMaster the right, in its sole discretion, to modify the Service at any time and from time to time, without notice. Such modifications to the Service may include, without limitation, adding, modifying or removing features and/or functionality, and suspending or discontinuing the entire Service.

Your content and information:
a. Posting content
PlantMaster allows you to post content, including plant data, images, comments, links, and other materials. Anything that you post or otherwise make available on PlantMaster is referred to as “User Content.” You retain all rights in, and are solely responsible for, the User Content you post to PlantMaster

If you post your content on PlantMaster, it still belongs to you.
b. How PlantMaster and other users can use your content
If you post your content to PlantMaster, it remains your content. PlantMaster and any of our users cannot share, use, or otherwise reference your images, descriptions, planting plans etc. Your content remains private unless you chose to share it publicly.

We will not share or use your information or images in our public site. Anything you add is yours privately to use.
c. Image rights
Any images you add to PlantMaster that you have taken or own rights to, retain your copyright. PlantMaster will not share, use, or copy any images that you provide to the system, unless you authorize us to do so.
Moreover, If we have mistakenly used any images against your will, we will remove them immediately. We often get permission to use images from our customers, and they sometimes forget if they have copied an image or description from another source. Please contact us directly support@plantmaster.com if we are using your images or descriptions without your permission.

We have no intention of stealing or using your images or data. If we have done so, please contact us at support@plantmaster.com and we rectify the issue immediately.
d. Your feedback
We value hearing from our users, and are always interested in learning about ways we can make PlantMaster more awesome. If you choose to submit comments, ideas or feedback, you agree that we are free to use them without any restriction or compensation to you. By accepting your submission, PlantMaster doesn’t waive any rights to use similar or related feedback previously known to PlantMaster, or developed by its employees, or obtained from sources other than you.

Security:
We care about the security of our users. While we work to protect the security of your content and account, PlantMaster can’t guarantee that unauthorized third parties won’t be able to defeat our security measures. We ask that you keep your password secure. Please notify us immediately of any compromise or unauthorized use of your account.

Third party links, sites, and services:
PlantMaster may contain links to third party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by PlantMaster. We don’t endorse or assume any responsibility for any such third party sites, information, materials, products, or services. If you access any third party website, service, or content from PlantMaster, you do so at your own risk and you agree that PlantMaster has no liability arising from your use of or access to any third party website, service, or content.

PlantMaster may contain links to content created outside of PlantMaster. Most of the stuff people link to is great, but we’re not responsible when it’s not.
Service downtime:
PlantMaster does not guarantee that your access to and use of PlantMaster will be uninterrupted and does not guarantee any minimum availability to PlantMaster. PlantMaster will not be liable to you or any third party for any loss or damages related to or arising out of any period of time during which you are unable to access PlantMaster.

Termination:
PlantMaster may terminate or suspend your right to access or use PlantMaster for any reason on appropriate notice.
Disclaimers:
PlantMaster takes no responsibility for the use of the information provided on our site. We provide the best information we can. Your use of that information is your responsibility. PlantMaster assumes no liability for any User Content that you or any other person or third party posts or sends using our Service. You understand and agree that you may be exposed to information and User Content that’s inaccurate, objectionable, or otherwise unsuited to your purpose.

Limitation of liability:

General terms:
We reserve the right to determine the form and means of providing notifications to you, and you agree to receive legal notices electronically if that’s what we decide. We may revise these Terms from time to time and the most current version will always be posted on our website. By continuing to access or use PlantMaster after revisions become effective, you agree to be bound by the new Terms. If you don’t agree to the new terms, please stop using PlantMaster.
